Terms of Service

1. Acceptance of Terms

By accessing or using the Kansova AI platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Kansova AI Inc. ("Kansova," "we," "us," or "our").

2. Description of Service

Kansova AI provides an AI-powered workspace for generating architectural renders, images, and video content ("Outputs") based on text prompts and other inputs provided by users. The Service includes web-based tools, API access (for eligible plans), and related features. We do not guarantee that Outputs will meet your specific requirements or expectations.

3. Account Registration and Security

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Account Suspension and Termination. We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to: violations of these Terms or our Acceptable Use Policy, fraudulent activity, non-payment, or conduct that we determine to be harmful to the Service or other users. Upon termination, your right to use the Service will immediately cease, and any unused credits may be forfeited at our discretion.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Generate content that violates any applicable law or regulation;
  • Create, promote, or distribute content that is defamatory, obscene, harassing, hateful, or discriminatory;
  • Infringe upon the intellectual property rights of any third party;
  • Attempt to reverse-engineer, decompile, or extract the underlying models or training data;
  • Use the Service to generate deceptive or misleading media ("deepfakes") for fraudulent purposes;
  • Interfere with or disrupt the integrity or performance of the Service.

Violations of our Acceptable Use Policy may result in immediate account suspension, termination, and reporting to relevant authorities. See our full Acceptable Use Policy for details.

5. Credits, Quotas, and Usage

Credit System. The Service operates on a credit-based system. Different generation types and models consume varying amounts of credits per request. Credit allocations are determined by your subscription plan. Free tier users receive a limited number of credits per month; paid subscribers receive a larger allocation.

Credit Expiration. Subscription credits reset at the beginning of each billing cycle and do not roll over. Purchased top-up credits remain valid for 12 months from the date of purchase, unless otherwise stated.

No Refund for Unused Credits. Unused credits at the end of a billing cycle are forfeited and are not eligible for refund or conversion to cash. Credits have no cash value and cannot be transferred between accounts.

6. AI-Generated Content and Intellectual Property

Your Ownership. Subject to your compliance with these Terms and applicable law, you retain all right, title, and interest in and to the Outputs you generate using the Service. To the extent that any Output is not eligible for copyright protection under applicable law, you are granted a perpetual, worldwide, royalty-free license to use such Output for any purpose.

Our License. You grant Kansova AI a limited, non-exclusive, royalty-free license to use, reproduce, and display your Inputs and Outputs solely to the extent necessary to provide, maintain, and improve the Service. We do not claim ownership of your Inputs or Outputs.

No Warranty of Uniqueness. Due to the nature of generative AI, similar or identical Outputs may be generated for different users. We do not guarantee that any Output is unique or that it does not resemble existing works. You are responsible for ensuring that your use of Outputs does not infringe third-party rights.

AI Content Responsibility. You acknowledge that AI-generated content may contain inaccuracies, biases, or unexpected results. You are solely responsible for reviewing, verifying, and ensuring the appropriateness of any Output before use, publication, or distribution. Kansova AI is not liable for any damages arising from your reliance on or use of AI-generated Outputs.

7. Subscriptions and Payments

Certain features of the Service require a paid subscription. All fees are exclusive of applicable taxes. Subscription fees are billed in advance on a monthly or annual basis, depending on your selected plan. You may cancel your subscription at any time; cancellation will take effect at the end of the current billing cycle. No refunds will be provided for partial months except as specified in our Refund Policy.

8. Service Availability and Failures

No Uptime Guarantee. While we strive to maintain high availability, we do not guarantee that the Service will be available at all times. The Service may be interrupted for maintenance, updates, or unforeseen technical issues. We are not liable for any losses resulting from Service downtime.

Failed Generations and Credit Refunds. If a generation fails due to a technical error on our servers (not due to user error, invalid prompts, or network issues on your end), the consumed credits will be automatically refunded to your account within 24 hours. To dispute a credit deduction, you must contact us within 7 days of the failed generation with the generation ID and timestamp.

Unsatisfactory Results. We do not offer refunds or credit returns for generations that complete successfully but do not meet your subjective quality expectations. AI generation is inherently variable, and results depend on prompt quality, model selection, and other factors.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, KANSOVA AI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KANSOVA AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

12. Changes to Terms

We may revise these Terms from time to time. The most current version will always be posted on this page with an updated "Last updated" date. By continuing to access or use the Service after any revisions become effective, you agree to be bound by the revised Terms. Material changes will be notified via email at least 14 days before taking effect.
